Important Updates

Deadline for Making a Claim:

The deadline to make a claim expired on November 7, 2022.

However, if you did not file a claim before November 7, 2022, for reasons beyond your control and still wish to submit a claim, please contact your Counsel before March 7, 2023.

Previous communications with lawyers do not count as submitting a Claim Form.

Payment Update:

If you requested a replacement payment, the Administrator is working to issue your payment as soon as possible. Please be warned that issuing a stop payment on the original cheque and issuing a replacement cheque can take some time, so please be patient. Please be advised that payments are issued in batches, and agents are unable to share a timeline for your individual payment. We thank you for your understanding.

  • The equal share of the Net Aggregate Damages Award (NADA) has been calculated at $5,469.85 CAD. The Gross Aggregate Damages Award (GADA) is $8,411.23.
  • The pro rata NADA payments for federally incarcerated inmates were issued on or about January 17, 2023 by Correctional Service of Canada (CSC). The funds were deposited in the inmate savings account of each eligible incarcerated claimant (whose claim is NOT deficient). Note that if a claimant was released after CSC deposited the payment, the claimant will be provided with the means to access their money upon their release.
  • The NADA payments for non-federally incarcerated inmates (whose claim is NOT deficient) were issued on January 24, 2023.
  • Please note that certain provincially incarcerated inmates entitled to receive a pro rata NADA payment may have been issued two (2) separate cheques in order to be able to deposit the total amount in their inmate account (one (1) cheque of $5,000.00 CAD and one (1) cheque of $469.85 CAD, for a total of $5,469.85 CAD).
  • If you are deemed eligible to receive a pro rata NADA payment but your claim remains deficient (OR you requested a special payment arrangement and more information is required to issue the payment), the deficiency must be cured before we can issue your NADA payment.
  • Cash your cheque(s) immediately.

Please note that most of the NADA payments have already been paid at this time. If you already selected Track 2 or Track 3, your claim is either being processed or has been processed. Payments have started to be issued for Track 2 claims where the Court has issued a final Order.

For further updates regarding payments, please visit the website periodically.

The Court approved a revised Protocol on December 8, 2022. Due to changes to the Protocol (and the Claims Process), Process selection began again on June 12, 2023. Claimants will have 90 days to make their Track Selection from the receipt of the complete disclosure of their file by Correctional Services (Tier A and B). Also note that the Court approved another revised Protocol on December 19, 2024.

Address & Contact Info Changes

Please promptly notify the Claims Administrator of any changes to your contact information as we use what’s on file to communicate with you. When providing changes, please provide your full name, your claim ID (if applicable), as well as confirm the old contact information and the change requested.
